WIll this end well?

The Supreme Court has decided to review whether "whether strict local and state gun control laws violate the Second Amendment".

This could be good, because this could lead to a lessening of strict gun control laws in some states that are not currently 2nd amendment friendly.

It could be bad, because it could end up that these laws are actually upheld. But that would mean that the Supremes have to reverse themselves regarding Heller.

Precedent setting, either way.

On the one hand, I believe in the 2nd amendment. I am a strict constitutionalist, therefore the 2nd amendment means just what it says...."shall not be infringed" means just that. I do not believe that any license is needed to carry, either concealed or openly, nor to possess any "arm". Does that mean full automatic firearms and RPG's should be legal? Yes. Sawed off shotguns? Yes. Arms are, after all, arms. Who gets to limit them? If they are limited, we are violating the part about "shall not be infringed". While the original "arms" referred to the muskets and such that were the technology of the day, there were no limits placed then, no limits as to what kind, nor how many "arms" . "shall not be infringed". Enough said.

On the other hand, there is that pesky 10th amendment. States rights and all that. Just in case you need a refresher, it reads "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.".

Does the 2nd trump the 10th? We shall see. One could argue that the 2nd is came 2nd, as a part of the original Constitution, and the 10th was, IIRC, added later. You also have the Articles of Confederation..."Each state retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States".

I dunno, this will be interesting though. Let's see how the spin ges in non 2nd amendment states. Should be interesting arguments from the east coast folks, and from Illinois, and especially from the PRK (People's Republik of Kalifornia)...

One issue is the viewpoint of the constitution. I see it as a limiter for government, not a document bestowing rights to the "people". Others see it as giving rights to the "people", not a limit to what government can do.

Glowbal Warmening discussed at length

This is worth a read, it is long as hell, but worth reading nonetheless. It breaks down the issues with the global warming climate change fallacies better than any other argument than I have ever seen.

Excerps:

The AGW hypothesis is based on temperature rises between about 1975 and 1998 or about 25 years worth of data. This is claimed to be definitive yet the last 10 years worth of data shows falling global temperatures. This is claimed to be a short term aberration and of no consequence. I do not see how 25 years can be considered definitive beyond dispute while 10 years of data is a short term aberration, too short to be significant. I would have thought at least a 10:1 ratio would be necessary to make such a claim.

AND:

For the last 10 years the global temperature data shows either no atmospheric temperature rise or indeed a falling global temperature. Recently this has been claimed to be due to a combination of a quiet sun and changes in ocean circulation superimposed on the underlying warming trend. The further claim is that when these effects reverse, warming will start again with a vengeance.

If these natural processes can cancel out the impact of AGW then they are as powerful as AGW. If they can overwhelm the impact of AGW to cause cooling they are more powerful, yet IPCC and other AGW proponents have claimed in previous assessment reports that solar influences are only a minor contributor compared to CO2.


Take the time to read the whole thing. It pretty well trashes the "logic" that is used in the AGW arguments.

So Yosi Sergent (NEA communications director), has "resigned". It would seem that his complicit promotion of the Obama agenda has led to his shame....Enough shame that he felt it necessary to tender his resignation. Said resignation was, of course, enthusiastically accepted. He will be sacrificed so that the political careers of others higher up in the food chain might live on.

Wonder what plum assignment they have in mind for him (in about 6 months)?

The Chicago Way....The apples don't fall far from the tree

So everyone is up in arms about the telephone conference between the White House (via Buffy Wicks...who works for Obama via Valerie Jarret) and the NEA...

DUH.

Did anyone expect that the true colors of a Chicago politician and his Chicago Staff would not eventually shine through? Strongarming those whose funds you control is a good old Chicago method of control. It's not like this sort of tactic is a new idea. The art has been polished and refined for many years. (see also: Mayor Daley....Both of them) Lets face it. Mr B. Obama is a product of his environment. It's how he got where he is today, via the power structure that works by twisting arms. If you are surprised, then you are either not paying attention to who he is, have spent the last few years in an alcoholic or drug induced haze, or you have the intelligence of limp broccoli.

The fact that they thought that they could get away with it is the real issue. Not so much that fact that they tried....Or the fact that we know about it.

Lets forget about the fact that the government has no mission to (nor mandate either) fund what some artist might call art. (nah, lets talk about it) IMNSHO that should be left to the rich...Let them decide what "art" they would like to endow with funds. Let other foundations choose (or not) to promote artists. It is not for the government to choose what to fund.

The fact is that the transcripts show that the NEA has failed in its mission. It has betrayed those who created and supported it. It has, while not necessarily offered money to those who are funded by NEA grants, at least threatened and coerced them to be pro-Obama in their "art" endeavors. NEA is supposed to be there because "art and humanities is for everyone" (actually it is colossal waste of taxpayer money for a bunch of liberal weenies who congratulate each other's work in a never ending circle jerk, all funded with someone elses money.

We should, IMO, immediately de-fund the NEA, for the same reasons we defunded Acorn.

(Personally, I'd burn the administrators of the NEA at the stake, but then again, I am like that for people who betray the trust ....)

But then again, perhaps we can get more posters like THIS.

Because they think they know better than you do

The left thinks (at least their elite "intelligentsia" do) that they know better than the rest of us how to take care of ourselves. If we would only take their advice, and live the way "they" say, we, as society at least, will be better off. Of course, we, as individuals might not be better off, but society as a whole will be better. (hint, that's why they call them socialists....)

Instead, they feel that we "act like teenagers"...Unruly teenagers at that. Unable to make decisions without guidance from a parent-like government. How condescending, how paternalistic....how elitist.

They have no idea, however, how unruly people can be when a socialist begins to tell them how hot or cold they can make their house. The people of this country can only be pushed, can only take so much. We are, after all, used to freedom, and will only brook so much interference in their lives. Even though they are trying to "boil the frog slowly", the frog will only take so much heat.

Willing to let the government turn back your thermostat or your water heater because they think that they have a better use for the electricity that you would use for heating you hot water or heating or cooling your house? That's what the elitists think they should be able to do with the "smart grid" at your house. You gonna let them decide how hot or cold you must be? Gonna sit idly by as they choose who gets power and who doesn't?

Betcha that they find out what truly unruly children we can be, should they decide to try to implement this scheme.....

But that is another topic for another day.

Health care legislation is dead......really.

So yesterday the comment was made that there would be some kind of health care legislation and how would it change our current situation.....My take is that there will be no legislation at all, simply because no politician will be willing to vote "yes" on any legislation concerning changing of our health care. Since the DNC and it's minions couldn't push the thing through quickly and early, then they have lost the initiative and anything related to such a bill is toxic....The "third rail" of politics.....No politician who wants to get elected in 2010 or even 2012 will vote for any health care bill. Even in so-called blue states.

So ultimately, since the votes won't be there, they will table things for a year or so and try again...All the while claiming "victory" .

The thing is, if they really want to change things for the better, and help people be insured, then there are a lot of reform opportunities available, just none that will make splashy headlines.. Tort reform, changing regulations to allow better purchasing, co-ops, streamlined regulations, etc. But do they ever propose this? Nope.

The real thing is, is this about helping people or about power?? Ultimately, I think it is about power and control over you and me. Control over your health care is control over you. And for a socialist, (or if you prefer, a statist) control over the individual by the state is everything...

The thing is with these people, they never give up and they never stop. They are back year after year, trying each and every time they think that they get a chance.

Let's not let them have that chance.
Finally got a chance to post......Had to do a hack on the Prius to get the electric only mode to work....This might just save me some real significant amounts of gas....

I'd have posted sooner, but getting home I had all number of chores to do, and little time to post last night. Then today, as I said, I had the install to do on the Prius and then cooking....grilled steak with angel hair pasta and grilled peppers with mushrooms, onions and green onion shoots....

Had a great time a the BlogMeet yesterday (Sunday). If you are in the area and can attend the next one, I HIGHLY recommend spending time with these folks. Intelligent, well spoken, interesting, well thought out people.

I met Roberta (of course) and Old Grouch, and Shermlock, and One MansVote, and a few others....

While some are smart asses (all in good fun!!!), they are all highly intelligent, very entertaining, and worth the time to meet. I hope to be able to make the time to do other BlogMeets. But the drive is about 1:45 so it can be problematic.

Many thoughts whirled around the table that few hours, and many things were discussed. We didn't solve the world's issues, but we discussed many of them and it was good, and the food was excellent. I followed Roberta's lead in getting the buffalo burger with mushrooms, cheese and bacon (MMMM, Bacon!).

Go, if you can.

If not, you'll be the poorer the next day.

222 years ago today

Today is, BTW, Constitution Day.

222 years ago today, 39 brave men signed a document that gave meaning to the new nation. 222 years ago today, those brave men signed their names to a document which set the framework for a nation that grew faster than any other in the world, and attracted the best, brightest, strongest, gutsiest, most productive people in the world from their home countries in the quest for freedom. They built a country which, in only a century and a half, became arguably the strongest, most productive, most free nation in the world.

In signing that document, those men made life better for those who had the courage and intestinal fortitude to make the move from their homes in the search for a better life. In the 1800's it was, generally, a one way trip. Yet thousands upon thousands chose to move to this new land of opportunity and freedom, created and sheltered by the words placed on that document. Poles, Russians, Germans, Englishmen, Chinese, Greeks, Africans....... Hindu and Muslim, Buddhist and Christian....From all continents they came, in the quest for freedom and opportunity that the Constitution promised.

Let us all take the time to thank those brave men, and to thank whatever deity you speak to that they had the courage to create that document and to make it the law of the land.

And let us never let the defense of that wonderful document ever become anything other than our highest priority, even unto revolution against those in government who would ignore it or circumvent its meaning.

Good news!

Perhaps even the house is able to see whats what....Or perhaps they are deciding to get in front of this, and sacrifice ACORN to keep the rest of us voters happy.

Either way, it is a great thing that the issues with ACORN have finally been made public enough that even the MSM decided to report on it...of course, it is sad that the media is so in the pocket of the liberals that it took 2 youngsters to do the MSM's work for them. Its not like there were any real surprises in the allegations against the folks from ACORN...

Of course, the bills are not compatible between the House and Senate, and they will, if we allow it, probably quietly let the issue die without reconciling them, but only if We The People lat them....

Now....the real question:

Will Mr. Obama have the gall, the effrontery to veto this bill, if and when? Or will he throw his friends, colleagues and staunch supporters to the wolves....

Either way, this is great news.

So I have a suggestion to all you liberals who seem to think that everyone should pay taxes, and that it's ok to decrease health care for those of us who work for it to give health care to those who either don't or who cannot afford it:

Here's the thing...You are welcome to work as hard as you wish, but if you think that we all should pay more taxes, then please, set an example. Feel free to pay all of your income to the government, keeping only enough to keep you above the poverty line.

Feel free to take the time to claim an uninsured person as a dependent on your insurance....Hell, claim 6 or seven on the family plan.

Just leave my money and my health insurance alone.

For you liberals making 6 or more figures.....Please re-read the above. spend your income like you want the rest of us to. You really don't need that McMansion, or the three (or more) cars...The boat, the condo on the lake, etc..

Put your money where your politics are.

Or else just shut up and go away.

So the right has made a statement.....Will anyone listen? We conservatives have, with our tea parties, and now the march on Washington of something in excess of 1.8 million people, made our first statement. Will the current officials take heed? Will the GOP party officials? One would have to estimate that each of those who attended could easily represent 10 or more people, perhaps as many as a hundred. If so, at least 18 million people and as many as 180 million dislike the current direction of more tax and spend and more big government. We want change, but not the kind that is currently in the wind. People are angry. They were unhappy with George W. Bush, and are even more unhappy with Mr Obama's ideas. Health care, Cap and Trade, Stimulus. Enough is enough. Stop, already.

Or will this die down and die before the 2010 election and will we as a people choose to elect more of the same?

One thing I hope that we can shout to our officials is that we are here, and we won't go away. We have been told that we, each of us, was alone in our anger and protest. We know better now. We know that each of us has tens (hundreds?) of thousands of sisters and brothers who feel the same anger, and the same frustration. Each of us now knows that we are not alone.

Will the GOP and the libertarians learn a lesson here? Will they give us more of the same....More RHINO's and more Democrat Lite? Will they learn and support those who would truly represent what the people want and seek? Or will they choose to again throw the opportunity away, and give the people an even less appealing candidate than the trash that the DNC throws to us for a choice of representative in 20 10 and 2012 and, in 2 years, president in 2012? Or will they present us with a choice that we can get behind, choose to support and campaign for, and who is electable? I mention the RNC and the Libertarians, because the DNC is apparently a lost cause....

Will the leadership in the Senate and the House decide to listen, or will they stubbornly choose the direction which they have taken lately....Ignore the constituents and make decisions according to party lines and politically traded favors? One would think that these men who have been elected to represent us are intelligent to make the choice that keeps them elected. Yet evidence shows otherwise. Will this protest make a difference? Or will it be ignored by incumbents and political parties alike?

We can choose to elect others, if we are given a choice, or if we choose to vote against the current party structure. Let us hope we can have a candidate (or candidates) for which we do not have to hold our nose, but rather one which we can enthusiastically support.

Before there is a revolution.

BTW, anyone notice that the trash left by this group is about 1% of the trash left by the attendees of the inauguration or that of the election party in Chicago? Perhaps the conservatives folks are really more green that the liberals...

Yet another commentary on 9-11

This is, I know, long. I hope that you read it. I hope it makes you think.


The day was 9-11-09. It was a beautiful morning. A normal day. No one knew that this would be
the day that we in the US finally took notice of the war the Islamist radicals had declared on
us years ago.

A war it had been, just an ineffective war. Like flies buzzing around us, we ignored them,
occasionally swatting at them, neither side having much effect on the other. We as a nation
took no real notice of the danger, and we ignored those who would harm us. The warning signs
were there, and we had been given plenty of notice by the other side in their previous
attacks. But ignore them we did.

No more. On that day, we learned, we took notice. But did we, as a nation, learn?
I remember thinking that it was a terrible accident, that morning, seeing the pictures on TV.
But knowing nothing, I left for work, not realizing that we were at war. I though it was just
another day, albeit one in which a errant airliner had had an accident.

At work about an hour later, I remember my employee telling me..."another one! Another plane
just hit the other tower!". I knew then, that very moment, that we were at war. I said to my
staff "the world as you know it has just changed, nothing will be the same after this day".

Was I right?

Have we changed? For a few months after the attacks, we pulled together as a nation, as a
people.

But how soon we forget.

Sadly, 8 years later, most have forgotten the horror that we all felt that day. Sadly, we
forgot the fear and anger that pulled us together. Islamic radicals are far away, being bled
and distracted by our finest young men and women, in a place most of us don't really care
about. We care little that our soldiers are undergoing deprivation and are under constant
deadly danger in order that we might have the luxury to forget.

And forget we have.

The additional security at airports, while probably ineffective (we really don't know or have
any way to measure), is just an additional irritation to the ordeal of flying somewhere.... No
one has really cared about the changes in the alert level...green, orange, yellow, red... We
really pay little notice and care even less. Do you know, right now, what the current "color
of the day" is? Do you care?

No one knows what the Bush administration has done to protect us, or the Obama administration either....How many successes have they had, of which we know nothing? How many plots foiled? All we know is that there have been no major attacks on our soil since that day.

Yet.

All that they (the islamists) have to do to succeed in elevating our fear and terror is to
succeed one more time. Until then, we might never know how many times our government has
successfully guarded us. We will only know if they fail.

Perhaps then we as a nation will remember, and pull together once more, forgetting our petty
squabbles and turning as one people to face a common enemy.

From where I sit, we have forgotten. We as a nation have let the lessons of that day slip from
our consciousness, and fall away to the abyss of obscurity. And for that, I am ashamed.

Individuals may still remember, many, such as myself, will never forget. But most, fed drivel
by the mainstream media, have indeed forgotten the horror and anger of that terrible day.

I have not forgotten. Have you?

Have your forgotten the day where we, the most powerful nation were attacked by a few men
using our own airplanes against us? Have you forgotten the fear, the anger (and yes, the hate)
that flowed like water that day? Have you forgotten that while on the first two planes people
(as far as we know) did not fight back, when the truth became known to the third set of
passengers that instead of being sheep, some occupants of that third airplane became wolves
instead and fought back? Can you remember the fact that for a short time, we became one people instead of blue or red, and for once, acted as a nation instead of a bunch of selfish, childish, individuals?

I have not forgotten. I remember those days with horror, and anger, and pride. Many have
forgotten, and many more will in the years to come.

I won't. Ever.

Watching Mr. Obama's speech

I am torn between :

Damn, he sure talks purty....("gee, Mr. Taggart, you use your mouth better than a twenty dollar whore")

And:

Liar! Liar!... pant's on fire!

Smooth delivery of a very carefully parsed speech, that leaves out a lot of details, and skips over a lot of things that are legitimate concerns. Skipping over the issues that are concerns, he highlights the good, while glossing over the details that are unpalatable to most Americans who care. He did downgrade the number of uninsured from, IIRC, 47 million to 30 million. Must have decided to not count those illegals he now has promised he won't cover...for today.

"Trust me" still remains the best thing he can come up with..."I can fix this for all of you" and "it won't cost anyone anything. I promise"....."I don't want to get rid of insurance companies, but I will undercut them with government backed plans".

No matter how you slice it, it is socialism. If he and his cohorts really wanted to fix things, they could. But they won't. They want socialized health care. Insurance reform isn't enough. Tax reform for health insurance purchased without your employer isn't even on the table. It's all about control. All the rest is empty promises, twisted truths, and outright lies. If you don't see that, then you are blinded by His light. And a fool.

If his plan is worth anything, he will present a plan and let the public review it for 90 days....rather than try to shove it down our throats. Betcha he doesn't.

Hats off to the man who cried "liar!" during his speech. Hope the Secret Service and Capitol Police don't stick the nightstick too far up hurt him too badly. That took balls.

Taught a new rifleman yesterday. Honed my skills as well.

But most importantly, taught the safe handling, rules and skills that were passed to me by my father, his father, and others, to another generation that he might be ready when and if he is needed. Nothing like passing knowledge on to another. That sharing leaves both teacher and student richer for the experience.

Tough decisions....Or, who are the enemies of the constitution?

The oaths begin the same way....

Enlisted men's oath
"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic;.... "

Officer's oath
"I, _____ , having been appointed an officer in the Army of the United States, as indicated above in the grade of _____ do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic....."

Both of these oaths state that the taker of the oath "will defend and support the constitution. So what does a military man do when the people giving orders (the lawfully elected and sworn government) may well be the domestic enemies of the state? When the president (and congress) has trampled on the constitution (and I am not just talking about the current president, lest there be any question about that)? When the government from which they take their orders is the entity destroying and violating the constitution which they swore to defend.

I ask because I am not sure how the members of the military can follow orders of the president, or not depose the Senate or the House members...They (the government officials) have become the enemies against which the military has sworn to defend...

Make no mistake, I am glad that they don't. But, they do have justification.....

What would you do if you were a general? The right thing? or follow the leaders who have violated the very thing you swore to defend?

I spent the day at the range today. Practicing for "the day" should it occur. Polishing skills passed on to me by my father and his father. Honing the one skill I might offer my country and its citizens in their time of need. Passing those skills onto another as well. I may not be good for much, but I can shoot. Not as well as some, but better than most.

Men are not deer, nor are they paper. They may however, be targets.

I hope that day never comes.....If it does, are you ready?

Or will you hide in your home and let others do the dirty while you cower?

Seems Mr Chavez isn't all that well liked as the press would have had us believe a few months ago....

I expect serious dissatisfaction to break out here in the US about Feb. of 2010. And it will be expressed at the ballot box and perhaps in other ways.

Seems that socialist policies don't make everyone happier and better off...

Would that Mr Obama, Ms Pelosi, and all of the other socialist Democrats realize this sooner rather than later.

Before we begin circling the rim like Britain and Venezuela. Before it's too late for us... as, I fear, it is for them.

Yep, I have heard it 4 times now from liberals.

Once from my brother, a state away, who is not so much a liberal as a follower....His wife was an academic who had to get a job in the private sector to pay her bills, but an unrepentant liberal nonetheless.

Once from a union man. A Teamster. Salt of the earth kinda guy, but a Teamster.....He regurgitates all of the liberal cant that is repeated at union hall meetings.

Once from an academic at VU....this is the sort of thing that one might expect from an academic at a state run university, but from a Lutheran university???

And once today, Saturday....I had business downtown, and, just for fun, stopped to laugh and point at the 6 (rather pathetic looking, I might add) folks waving signs (no longer pre-printed, but actual handmade signs so that we might think that they weren't astroturf or anything...) promoting government option health care. After watching them for a few minutes, I engaged the brightest looking one in conversation, asking him how he could stand behind such a socialist agenda as government run health care....His first response was "well, we are halfway socialist anyway....Medicare, roads, military, and police and fire and interstate highways are "socialist" endeavors, paid for by all for the "common good".... so why not health care?"

I did try to discuss the ideas with him, but it became apparent that he was not willing to discuss things, but rather was just going to repeat his memorized lines, so I politely thanked him for his time and wandered off. He returned to the group, no doubt thinking and crowing that he had chased away another conservative...Let him think so. It doesn't hurt me to have him feel good about his failure.

But the point of all of this is that this appears to be the new meme....."We are halfway socialist already, so what is one more socialist program or agenda item?"

Just wondering if others have come across this meme, and have you any good way to crush the assumptions that are so erroneous? Roads are paid for (at least in my state) by fuel taxes, as are the highways. Police and fire I can sort of understand, and couldn't argue with and the same with military, (except they are all part of the "common defense" mentioned in the Constitution.)

But is this going to be their next theme that they shall use to convince a few more people that socialized medicine is a good idea? Just another step down the road to pure socialism? Am I supposed to think that that is a good thing?

Mr Obama will address the schoolchildren and exhort them to "do more, do something for your country....." and "Obama will address students "about the importance of persisting and succeeding in school" at 1 p.m. Eastern at the WhiteHouse.gov website. The announcement said the federal Department of "is encouraging educators, students and parents to use this opportunity to help students get focused and begin the school year strong." The government also is publicizing a list of suggestions for students and teachers to do in preparation for the speech, including studying Barack Obama's writings and presidency. Obama had announced the speech during a child reporter's visiting the White House.

Not everyone is happy about it though....."You can call it what you will but Obama Youth or Hitler Youth … This is much too slippery a slope, this day and age with the role of government becoming more invasive the last thing I want is for 'them' to get a tooth into my kids,"

He might just want to try and make a difference in kids education by persuading them to do well in school......But then again, his record so far makes one wonder...what will he say? The NEA has already indoctrinated so many children already, so what will he say to make a real difference?

Van Jones, the Obama administration's "green jobs" adviser, told a group of listeners earlier in the year that the reason Republicans are stonewalling the president is because they're "assholes."

Jones' remarks were recorded in a video from February that was posted to YouTube.

He made the remark during an energy lecture in Berkeley, Calif., after a woman in the audience asked him why President Obama and congressional Democrats were having trouble moving legislation -- even though Republicans, with a smaller majority, didn't have as much trouble earlier in the Bush administration. "Well, the answer to that is, they're assholes," Jones said, to uproarious laughter. "That's a technical, political science term."

Apparently, it was ok to block the Bush administraation's legislation, but not the Obama administration's.

These people act like children. Poorly raised children at that.

The scary part is that they are nominally in charge now.

"Hope and Change" and all that.
